These Terms of Service (“Terms”) govern your access to and use of the PSL Max mobile application, websites, backend services, AI image-generation features, face-scan features, analytics, routine features, community features, paid features, support channels, and related services (collectively, the “Service”).

By downloading, accessing, or using PSL Max, you agree to these Terms. If you do not agree, do not use the Service.

These Terms include important disclaimers, limitations of liability, rules for photos and community content, paid-feature terms, and an optional arbitration section that should be reviewed by counsel before publication.

1. Eligibility

You must be at least 17 years old to use PSL Max, or older if required by local law. By using PSL Max, you represent that you meet the age requirement and have the legal capacity to agree to these Terms.

PSL Max is not directed to children and is not intended for use by anyone under 17. Do not use PSL Max if you are prohibited from using the Service under applicable law.

If you use PSL Max on behalf of another person, business, or organization, you represent that you have authority to bind that person, business, or organization to these Terms.

2. What PSL Max Does

PSL Max is an AI-assisted appearance analysis, image generation, routine, analytics, and community app. Features may include:

• Face scans and scan previews;
• Appearance-related estimates, category scores, PSL estimates, potential estimates, and progress analytics;
• Onboarding and personalization;
• Routines and informational self-improvement guidance;
• AI-generated images based on selected inputs and your scan/image data;
• Community posts, comments, replies, voting, saving, reporting, and blocking;
• Paid features, subscriptions, trials, consumables, non-consumables, or other in-app purchases;
• Support, feedback, and related services.

We may add, remove, change, limit, or discontinue features at any time, subject to applicable law and platform rules.

3. No Medical, Surgical, Dental, Psychological, Nutritional, or Professional Advice

PSL Max does not provide medical, surgical, dental, orthodontic, dermatological, psychological, nutritional, fitness, dating, legal, financial, or other professional advice.

Any routines, analysis, insights, “hardmaxxing,” “softmaxxing,” “experimental,” “natural,” body-composition, skincare, posture, grooming, exercise, dental, orthodontic, dermatology, cosmetic, surgical, or appearance-improvement content is for general informational and entertainment purposes only.

Do not use PSL Max as a substitute for professional advice, diagnosis, treatment, consultation, or emergency assistance. Always consult a qualified professional before making medical, surgical, dental, orthodontic, dermatological, nutritional, fitness, mental health, body-modification, or other health-related decisions.

If you experience pain, distress, disordered eating thoughts, self-harm thoughts, body-image crisis, medical symptoms, or an emergency, stop using the Service and seek help from qualified professionals or emergency services.

4. Appearance Scores, Analysis, and Results Are Estimates

PSL Max may provide scores, labels, rankings, progress estimates, potential estimates, projected timelines, category ratings, or similar outputs. These outputs are estimates generated by software, models, rules, or AI systems and may be affected by lighting, pose, camera quality, expression, hairstyle, facial hair, device type, model limitations, user inputs, and other factors.

PSL Max does not guarantee that any score, analysis, recommendation, routine, image, or insight is accurate, objective, complete, reliable, safe, or suitable for you.

PSL Max does not guarantee any appearance, dating, social, confidence, career, health, fitness, medical, surgical, dental, financial, or personal outcome. Any references to “potential,” “ascension,” “90 days,” “future you,” “top tier,” or similar language are motivational product language and estimates, not guarantees.

You should not use PSL Max outputs to make decisions about employment, housing, lending, education, insurance, healthcare, legal status, or other consequential matters.

5. AI Image Generation

PSL Max may offer AI image generation features. AI generation may use your selected image, latest scan image, scan details, prompt selections, and generation metadata to create an output.

AI-generated images may be inaccurate, unrealistic, biased, visually imperfect, inconsistent, or not representative of real-world outcomes. Generated images are not medical, surgical, dental, psychological, dating, professional, or personal advice.

You are responsible for your use of generated images. You may not use AI-generated images to mislead others, impersonate someone without permission, create deceptive identity content, harass others, exploit minors, create sexual content involving real people or minors, violate rights, commit fraud, or engage in unlawful conduct.

By using Generate, you agree that PSL Max may process your submitted image and generation details as described in the Privacy Policy and any just-in-time AI consent screen presented in the app.

6. Your Photos, Face Images, and Consent

You must have all rights, permissions, and consents necessary for any photo, video, scan, face image, generated image, text, or other content you upload, scan, generate, post, or share through PSL Max.

You may not upload, scan, generate, post, or share images of another person unless you have that person’s clear permission and the use complies with these Terms and applicable law.

You may not upload, scan, generate, post, or share images of minors through Community or AI generation features unless expressly permitted by the app and lawful guardian consent has been obtained. Sexual, exploitative, humiliating, harassing, or objectifying content involving minors is strictly prohibited.

You may not use PSL Max to rate, shame, objectify, expose, dox, harass, compare, or judge non-consenting people.

7. User Content

“User Content” means any content you submit, upload, create, post, save, transmit, or otherwise provide through the Service, including photos, scans, generated images, posts, comments, replies, usernames, reports, feedback, and support messages.

You retain ownership of your User Content, subject to the license you grant us below.

By submitting User Content, you grant PSL Max a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, process, reproduce, modify, create derivative works from, display, publish, transmit, distribute, and otherwise use your User Content solely as needed to operate, provide, improve, secure, moderate, and support the Service; comply with law; enforce these Terms; and exercise rights described in our Privacy Policy.

For Community content, this license includes the right to display your content to other users and to preserve moderation, safety, report, and abuse-prevention records.

For AI generation, this license includes the right to process your submitted image and generation instructions to create the requested output, operate the feature, troubleshoot, enforce safety rules, and maintain service security.

You are responsible for your User Content and the consequences of submitting it. We are not required to host, display, preserve, or return User Content.

8. Community Rules

PSL Max may offer Community features. Community is intended for respectful discussion, self-improvement, routine support, product feedback, and app-related conversation.

You agree not to post, submit, request, encourage, or engage in content or behavior that includes:

• Harassment, bullying, threats, intimidation, stalking, or targeted abuse;
• Objectification of real people, including “hot-or-not” voting, face-rating contests, “rate this person,” “mog battles,” or similar comparative judging of non-consenting people;
• Non-consensual photos, private images, intimate images, or images of another person without permission;
• Sexual content, pornography, sexual solicitation, or sexually explicit discussion involving real people;
• Any sexual, exploitative, suggestive, or inappropriate content involving minors;
• Hate speech, slurs, extremist content, dehumanization, or attacks based on protected characteristics;
• Doxxing, sharing private information, exposing identities, or encouraging harassment off-platform;
• Impersonation of PSL Max, staff, moderators, public figures, or other users;
• Medical, surgical, dental, steroid, prescription-drug, eating-disorder, self-harm, or dangerous advice presented as instructions or guarantees;
• Promotion of self-harm, suicide, eating disorders, violence, or reckless behavior;
• Spam, scams, phishing, malware, automation abuse, fake engagement, or platform manipulation;
• Illegal content or activity;
• Content that infringes intellectual property, privacy, publicity, or other rights;
• Attempts to bypass moderation, filters, username rules, reporting systems, or technical protections.

We may remove content, restrict visibility, issue warnings, suspend users, ban users, lock usernames, preserve evidence, report content, or take other action at our discretion.

We may provide tools to report content and block users. Reports should be used in good faith. Abuse of reporting tools may result in enforcement action.

9. Username Rules

If PSL Max offers usernames, your username may be permanent and may not be changeable. You are responsible for choosing a username that complies with these Terms.

Usernames may not:

• Impersonate PSL Max, staff, moderators, support, official accounts, public figures, or another person;
• Include profanity, slurs, sexual content, hate, extremist references, threats, harassment, or offensive language;
• Infringe trademarks, publicity rights, privacy rights, or other rights;
• Mislead users about affiliation, identity, authority, or endorsement;
• Be used for spam, scams, abuse, evasion, or platform manipulation.

We may reject, reserve, rename, disable, or reclaim usernames at our discretion, including usernames such as admin, moderator, mod, support, official, system, staff, developer, psl, pslmax, team, or confusingly similar names.

10. Prohibited Activities

You may not use the Service to:

• Violate any law, regulation, third-party right, or agreement;
• Upload or process content you do not have rights to use;
• Harass, bully, shame, exploit, objectify, threaten, or harm anyone;
• Create or distribute non-consensual intimate imagery or deceptive impersonation content;
• Upload, generate, or share sexualized content involving real people or minors;
• Use scan or AI outputs to make decisions about employment, housing, lending, education, insurance, healthcare, legal status, or other consequential matters;
• Provide medical, surgical, dental, mental health, steroid, drug, eating-disorder, or dangerous advice to others;
• Encourage unsafe body modification, extreme dieting, self-harm, violence, or reckless conduct;
• Reverse engineer, scrape, crawl, copy, modify, or interfere with the Service except as permitted by law;
• Access the Service through bots, automation, scripts, emulators, scraping tools, or unauthorized clients;
• Attempt to probe, scan, test, or compromise security systems;
• Upload malware, harmful code, or disruptive content;
• Circumvent paywalls, entitlement checks, rate limits, moderation, safety filters, username filters, or technical restrictions;
• Abuse refunds, chargebacks, promotions, referral systems, subscriptions, free trials, or payment systems;
• Use the Service for advertising, data mining, surveillance, facial recognition identification, biometric identification, or creating databases of faces;
• Sell, rent, sublicense, or commercially exploit the Service except as expressly permitted by us;
• Use the Service in a way that could damage PSL Max, users, Apple, service providers, or third parties.

11. Paid Features, Subscriptions, and In-App Purchases

PSL Max may offer paid features, subscriptions, trials, consumables, non-consumables, or other in-app purchases. When offered in the iOS app, digital features are purchased through Apple’s in-app purchase system unless otherwise permitted by Apple rules.

Prices, billing periods, trial periods, renewal terms, cancellation rights, and included features will be shown before purchase.

Subscriptions may automatically renew unless canceled at least 24 hours before the end of the current period, subject to Apple’s terms and App Store rules. You can manage or cancel subscriptions through your Apple ID account settings. Deleting the app does not automatically cancel a subscription.

Refunds are handled by Apple unless otherwise stated or required by law.

If a purchase is restorable, PSL Max will provide a restore mechanism where required.

We may change paid features, pricing, or subscription offerings going forward, subject to applicable law and platform rules. Existing subscriptions will be handled according to the terms presented at purchase, Apple rules, and applicable law.

You agree not to misrepresent your eligibility for offers, trials, discounts, promotions, or refunds.

12. Paid Promotions, Creator Features, and Sponsored Content

If PSL Max offers paid promotions, creator tools, sponsored placements, affiliate content, referral rewards, contests, or advertising in the future, those features may be subject to additional terms, eligibility requirements, review, approval, rejection, disclosures, tax requirements, payout thresholds, and moderation.

Paid promotion, creator, or sponsored content must comply with these Terms, platform rules, advertising laws, endorsement disclosure rules, and any additional instructions we provide.

We may reject, remove, label, limit, demonetize, or suspend promotional or creator content at our discretion.

Unless expressly stated in writing, Apple is not a sponsor of, responsible for, or affiliated with any PSL Max promotion, creator program, contest, or sweepstakes.

13. Intellectual Property and App License

PSL Max, including the app, software, code, design, visual style, branding, logos, text, graphics, models, systems, workflows, content, prompts, templates, databases, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use PSL Max for lawful personal purposes on Apple-branded devices you own or control, as permitted by Apple’s Usage Rules.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, create derivative works from, or otherwise exploit PSL Max except as allowed by these Terms or applicable law.

Feedback, ideas, bug reports, suggestions, or recommendations you provide may be used by us without restriction or compensation to you.

14. Third-Party Services

PSL Max may use or integrate third-party services, including Apple services, cloud hosting providers, AI providers, analytics or diagnostics providers, customer support providers, moderation providers, payment infrastructure, and security tools.

Your use of third-party services may be subject to third-party terms and policies. We are not responsible for third-party services we do not control.

If the Service uses, accesses, or displays third-party content or services, you agree to comply with any applicable third-party terms.

15. Privacy

Our Privacy Policy explains how we collect, use, share, and protect information. By using PSL Max, you acknowledge our Privacy Policy.

You agree that we may process your information as described in the Privacy Policy and as permitted by law.

16. App Store and Apple Terms

If you download PSL Max from the Apple App Store, the following additional terms apply:

• These Terms are between you and PSL Max, not Apple.
• Apple is not responsible for PSL Max or its content.
• PSL Max, not Apple, is responsible for providing maintenance and support for the Service, to the extent required by law and these Terms.
• Apple has no obligation to provide maintenance or support services for PSL Max.
• In the event of any failure of PSL Max to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to Apple’s policies. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to PSL Max.
• PSL Max, not Apple, is responsible for addressing claims relating to PSL Max, including product liability claims, legal or regulatory claims, consumer protection claims, and intellectual property claims.
• You must comply with applicable third-party terms when using PSL Max.
• You represent and warrant that you are not located in a country or region subject to a U.S. government embargo or designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

17. Service Management, Moderation, and Enforcement

We reserve the right, but do not undertake a duty, to:

• Monitor the Service for violations of these Terms;
• Investigate suspected violations, abuse, fraud, security incidents, or illegal activity;
• Remove, edit, restrict, label, or disable content;
• Restrict, suspend, or terminate access;
• Reject usernames or generated content requests;
• Preserve evidence and safety records;
• Report illegal or harmful conduct to appropriate authorities where permitted or required by law;
• Limit availability of features, categories, content, or services by region, age, account status, entitlement status, device type, risk level, or other criteria.

We do not guarantee that moderation will identify or remove all harmful content.

18. Corrections, Availability, and Updates

The Service may contain typographical errors, inaccuracies, bugs, incomplete information, or outdated content. We may correct errors, update information, or change features at any time without prior notice.

We do not guarantee that PSL Max will always be available, uninterrupted, secure, or error-free. Features may depend on internet access, Apple services, backend providers, third-party AI providers, device compatibility, app version, operating system version, and active entitlements.

You agree to install updates where required for security, compatibility, or continued use.

19. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSL Max DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
• RESULTS, SCORES, ANALYSES, ROUTINES, OR AI OUTPUTS WILL BE ACCURATE, RELIABLE, SAFE, OR SUITABLE FOR YOU;
• DEFECTS WILL BE CORRECTED;
• THE SERVICE WILL MEET YOUR EXPECTATIONS;
• ANY PARTICULAR APPEARANCE, HEALTH, SOCIAL, DATING, PROFESSIONAL, OR PERSONAL OUTCOME WILL OCCUR;
• COMMUNITY CONTENT WILL BE SAFE, ACCURATE, OR APPROPRIATE;
• GENERATED IMAGES WILL MATCH REALITY OR FUTURE OUTCOMES.

Some jurisdictions do not allow certain disclaimers, so some of these disclaimers may not apply to you.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSL Max AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, PERSONAL INJURY, EMOTIONAL DISTRESS, DEVICE FAILURE, SERVICE INTERRUPTION, UNAUTHORIZED ACCESS, OR THIRD-PARTY CONDUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO PSL Max FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM; OR (B) $100.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

21. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless PSL Max and its owners, officers, employees, contractors, affiliates, agents, service providers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

• Your use or misuse of the Service;
• Your User Content;
• Your violation of these Terms;
• Your violation of law;
• Your violation of another person’s rights;
• Your use of photos, face images, generated images, or Community content without required permissions;
• Your harmful, abusive, deceptive, or prohibited conduct;
• Your dispute with another user or third party.

22. Suspension and Termination

We may suspend, restrict, or terminate your access to all or part of the Service at any time if we believe you violated these Terms, created risk or legal exposure, abused the Service, harmed other users, or used the Service in a way that is unsafe, unlawful, or inconsistent with our product purpose.

You may stop using PSL Max at any time. If account deletion is available, you may request deletion through the app or by contacting us.

Termination does not automatically cancel an active Apple subscription. You must manage or cancel subscriptions through your Apple ID account settings.

Sections that by their nature should survive termination will survive, including ownership, licenses, disclaimers, limitations of liability, indemnification, dispute resolution, user content terms, enforcement records, and terms relating to prior use.

23. Copyright and Intellectual Property Complaints

If you believe content on PSL Max infringes your copyright or other intellectual property rights, contact us at HardtosayLLC@gmail.com with:

• Your name and contact information;
• Identification of the copyrighted work or right claimed to be infringed;
• Identification of the content you believe is infringing;
• A statement that you have a good-faith belief the use is not authorized;
• A statement that the information you provide is accurate;
• Your physical or electronic signature.

We may remove content and take action against repeat infringers where appropriate.

24. User Data and Backups

PSL Max may store certain data locally on your device and certain data on servers or with service providers, as described in the Privacy Policy.

You are responsible for maintaining your own copies of content that you want to preserve. We are not liable for loss, deletion, corruption, or failure to store User Content, generated images, scan data, routine progress, community content, or other data.

Some deleted data may remain in backups, security logs, moderation records, legal records, or provider systems for a limited period as described in the Privacy Policy.

25. Changes to the Service

We may modify, update, suspend, or discontinue features at any time, including free features, paid features, routines, Generate categories, Community features, analytics, scoring methods, and backend services.

We may release updates that add, change, or remove functionality. Some features may require an internet connection, compatible device, supported operating system, current app version, or active subscription.

26. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you in the app, by email, through the App Store, or by other reasonable means. Updated Terms are effective when posted or when otherwise stated.

If you continue using PSL Max after updated Terms become effective, you agree to the updated Terms.

27. Governing Law

These Terms are governed by the laws of [State/Country], without regard to conflict-of-law rules, except where applicable law requires otherwise.

If you are a consumer living in a jurisdiction that gives you mandatory consumer protection rights, nothing in these Terms limits those rights.

For users in the United States, you and PSL Max agree to first attempt to resolve disputes informally by contacting HardtosayLLC@gmail.com. If a dispute is not resolved within 30 days, either party may bring the dispute in binding individual arbitration, except for claims that may be brought in small claims court or claims for injunctive relief relating to intellectual property or unauthorized access.

You and PSL Max waive the right to a jury trial and agree not to participate in class actions, class arbitrations, private attorney general actions, or representative proceedings, to the extent permitted by law.

29. Electronic Communications

30. Miscellaneous

These Terms, together with the Privacy Policy and any feature-specific terms, are the entire agreement between you and PSL Max regarding the Service.

If any part of these Terms is found unenforceable, the remaining parts remain in effect.

Our failure to enforce a provision is not a waiver.

You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, sale of assets, corporate reorganization, or by operation of law.

Headings are for convenience only and do not affect interpretation.

No partnership, joint venture, employment, or agency relationship is created by these Terms.
